The general terms and conditions of sale define the rights and obligations of the sale online of goods and/or Services between:

hereafter referred to as the Customer,

The terms and conditions of online sales are governed by the laws of France.
In the event of litigation between the parties, arising from the interpretation or execution of these conditions, the courts to be consulted will be those covering the judicial region in which the registered head office of Baan is situated.  This agreement is governed by French law.
The Customer states to have full legal capacity to enter into a contract under these conditions.
The Customer accepts that the terms and conditions of online sales prevail over all other documents other than in the case of an express written and agreed exemption.

If a condition is found to be lacking, it would be governed by the procedures in force in the area of distance selling companies which are registered in France.

The terms and conditions of sale maybe the object of a modification in which case the applicable conditions are those in force at the time of purchase.


The website proposes the ensemble of products available from Baan.
Some products maybe momentarily out of stock or only available to order.

The catalogue is a reference for the products sold by Baan.  All payments made for a product which is unavailable will be subject to a notification indicating the dates of availability and allows for, if requested the reimbursement of the payment within 30 days.


The price of goods is that on the day of purchase.  The prices shown on the website are inclusive of local taxes.
Please note that the cost of shipping is additional and will vary with respect to the Customers order.
The cost of shipping will be clearly indicated at the time of validation of the order by our secure on-line payment system.


According to the law of 13 March 2000 on electronic signatures and in accordance with France's Digital Economy Law no. 2004-575 of 21 June 2004 the validation by the Customer executed by "double click" constitutes an electronic signature and is an irrevocable acceptance of the terms and conditions set out herewith and has the same value as a handwritten signature.
After the online order is made, the Customer will receive an email acknowledging the receipt of the order and confirming the tracking number of the shipment.

The email confirmation will confirm the Customers contact details and the contact details of Baan, the details of the order and the cost, the day the order was placed, the means of delivery and a receipt.


Baan uses a secure on-line payment system.  All purchases will be paid for in their entirety before dispatch other than in specific cases where there is prior agreement.

Payments are to be made using a bank card.  The secure on-line payment system is offered by the Caisse d'Epargne.  This same service is used for Customer reimbursements.


Baan will dispatch goods within a period of 30 days which is considered to commence the day after the order is placed.
In the event of out of stock items the client will receive an email notification indicating the dates of availability and allows for, if requested the reimbursement of the payment within 30 days.
Baan is not liable for product unavailability.   
The stated delivery times are a guideline and refer to the handing over of the consignment to the Post or Courier, hereby referred to as the shipping company.

Baan is not liable for late delivery due to the shipping company.

Once the order has been placed the customer will receive a tracking number in order to follow the progress of the consignment.
The consignment has a unique tracking number and describes both the shipping and delivery dates and is used in order to attest to proof of shipping and proof of delivery.  
In the case of a lost consignment by the shipping company Baan will offer to resend the order.

The Customer is duty bound to verify the condition of the consignment.  In the case of any damage the Customer is duty bound to refuse the consignment and to inform Baan of their actions.  Baan will offer the Customer a replacement or reimbursement of the damaged articles within 30 days of the damaged article(s) being returned.

In the case of defective goods, Baan will offer the Customer a replacement or reimbursement of the defective articles within 30 days of the damaged article(s) being returned.  Any claims for defective goods must be made within 2 days after delivery.


The Customer has seven (7) working days from the reception of his/her purchase to return it without having to justify motive, or pay any penalties other than the cost of the return shipping.
In case of exercising the right of withdrawal, the right to withdrawal is to be formalised by an email sent to or by letter. BAAN will make every effort to reimburse the consumer within thirty days.

The right of withdrawal within the 7 working day period does not apply to Services provided whereby the Customer has agreed to these Services.  
In the case of a withdrawal of a “made to measure” order, the Customer accepts to forfeit 30% of the total cost of the order.  The 30% is considered to a reasonable sum paid to Baan to cover expenses engaged by Baan in the administration, production and organisation of the Customers “made to measure” order.
